Wangs Alliance Corporation, known by many as WAC Lighting, filed a complaint with the International Trade Commission claiming patent infringement should prevent Hinkley Landscape Lights from being imported into the United States. The complaint says, “The Commission has received a complaint and a submission pursuant to § 210.8(b) of the Commission’s Rules of Practice and Procedure filed on behalf of Wangs Alliance Corporation d/b/a WAC Lighting on March 10, 2023.
The complaint alleges violations of section 337 of the Tariff Act of 1930 (19 U.S.C. 1337) in the importation into the United States, the sale for importation, and the sale within the United States after importation of certain LED landscape lighting devices, components thereof, and products containing same. The complaint names as respondent: Hinkley Lighting, Inc. of Avon Lake, OH. The complainant requests that the Commission issue a limited exclusion order, cease and desist orders, and impose a bond upon respondent alleged infringing articles during the 60-day Presidential review period pursuant to 19 U.S.C. 1337.”
Meanwhile, both WAC Lighting and Hinkley filed separate lawsuits in Ohio, with both suits claiming patent infringement. Hinkley’s accusation includes detailed diagrams and information about the creation of its 5 patents, while WAC Lighting claims it has sent numerous letters to Hinkley with its own patent infringement allegations.
Hinkley is headquartered outside of Cleveland, which is why the suit has been filed in Ohio.
